Peter Yim (TrialSite News) seeks court help to force NIH to release details of their vote on Ivermectin (whether there was a vote, and details of that vote that determined that more trials were needed)

Peter Yim who has written the critique of the Colombia JAMA paper's numerous problems for TrialSite News, now files a complaint in US court forcing NIH to reveal details of it's vote that dictated their revised ruling on Ivermectin (where they went from negative to neutral but still thought more trials are needed).

He is now seeking details about whether a vote was conducted and what were the details of the vote.

NIH is required to “determine within 20 days (excepting Saturdays, Sundays, and legal public holidays) after the receipt of any such request whether to comply with such request and shall immediately notify the person making such request of such determination and the reason therefore.” 5 U.S.C. § 552 (a)(6)(A)(i). At a minimum, within 20 days of receiving each of Yim’s requests, NIH was required by 5 U.S. C. § 552(a)(6)(A)(i) to (i) gather and review the requested records or seek statutorily permitted extension; (i)) determine and communicate to Yim the scope of any responsive records it intended to produce or withhold and the reasons for any withholdings; and (iii) inform Yim that it had the right to appeal NIH’s determination. See e.g. Citizens for Responsibility and Ethics in Washington v. Federal Election Commision, 711 F.3d 180, 188-89 (D.C. Cir. 2013). 27. Instead, despite the passage of more than 20 business days since NIH received the above request, it has failed to provide the statutorily required response.including failing to seek a permitted extension; determine and communicate to Yim the scope of any responsive records it intended to produce or withhold and the reasons for withholding; or inform Yim of right to appeal.

NIH refused to say if they held a vote on their ivermectin recommendation. Let's see what the US District Court for the District of NJ has to say about that.
